Creator Agreement

This agreement grants the Creator a licence to use the Platform - a tool for creating, managing and selling content - for business purposes only. It does not create an employment relationship, partnership, agency or joint venture, and grants no exclusivity to either party.

All rights in the app, brand, design, source code, interface, databases and technology belong exclusively to the Platform operator. The Creator receives a limited, personal, non-exclusive licence to use the tools for creating and selling content only, and acquires no ownership, intellectual property, goodwill or other right in the Platform itself.

Copying, reverse engineering, duplicating or building a competing product based on the Platform, its design or its code is prohibited.

Content uploaded by the Creator (maps, pins, descriptions, photos, videos and other original material - the “Content”) remains the Creator’s property. By uploading it, the Creator grants the operator a non-exclusive, worldwide licence to display, market, sell and distribute the Content within the Platform and its promotional channels, for as long as the Content is active or as required to operate the service (for example, serving customers who purchased it previously).

The Creator declares they hold full rights in the Content and that it does not infringe copyright, trademarks, privacy or any third-party right.

A platform commission at the rate shown in the creator profile at the time is deducted from each sale. Rates may vary between creators and may be updated from time to time with prior notice. The remaining balance is paid to the Creator according to the Platform’s payment mechanism and schedule.

The Creator is solely responsible for issuing lawful invoices/receipts to their customers and for reporting and paying all taxes applicable to their income. The operator is not a party to the sale for tax purposes and does not issue invoices on the Creator’s behalf.

The Creator is solely responsible for the accuracy, currency and legality of their Content, including locations, recommendations, prices and descriptions, and for supporting their own customers, including enquiries, complaints and cancellation requests, subject to Platform policy.

The operator is not responsible for creator-uploaded content and is not a party to any advice, recommendation or undertaking contained in it.

Copying, scraping, duplicating, automatically downloading or otherwise using other creators’ content or the Platform’s own content and data (including place databases, design and code) without explicit written permission is strictly prohibited. Breach may result in content removal, account suspension and legal action.

The operator may suspend or close a creator account, remove content and withhold payments in cases of breach of this agreement, abusive activity, infringing content, fraud, content theft, or harm to customers or to the Platform’s reputation, acting reasonably and giving notice where possible.

The Creator undertakes to comply with all privacy laws regarding customer information exposed to them through the Platform, and to use it solely for delivering the purchased service. Marketing mailings without explicit consent are prohibited, and every mailing must include a clear, immediate unsubscribe option.

The Creator may operate and sell content on other platforms and channels. Nothing here creates employment, partnership, agency or exclusivity; each party acts as an independent contractor.

The operator may update this agreement from time to time. The binding version is the one published on this page at the time of use, and continued activity constitutes acceptance.

This agreement is governed by Israeli law. Exclusive jurisdiction lies with the competent courts of the Tel Aviv-Yafo district.

The Creator’s acceptance (for example when creating a creator profile) is recorded in the system together with a timestamp, and serves as evidence of acceptance at that time.
